What A Premarital Agreement Covers

A premarital agreement (often called a prenuptial agreement) is a contract where both prospective spouses agree before marriage. The agreement becomes effective upon marriage. This agreement can cover anything and everything, provided it does not violate public policy. But remember, the court is not obligated to uphold any agreement concerning children. Typical coverage of an agreement includes: rights to particular property, disposition of property at divorce, spousal support, will and trust terms, insurance policy rights.

In order to make such an agreement enforceable, certain qualifications must be met. The form in which the agreement is drafted must also confirm to the statute dealing with premarital agreements. This also includes requirements for signatures and verification. Also, the environment in which the agreement is made must be fair and voluntary.
