What Is Post Separation Support

This type of support is paid for support of one spouse during pendency of an action for divorce or annulment.  To be entitled to the support, the spouse must prove that they are dependent on the other spouse and that the other spouse is a supporting spouse. And also, the award will only be given if it is equitable after considering factors including marital misconduct.

Post separation support, if award, will continue until at ending date stated in the order, an order concerning alimony,  an order of divorce or annulment is granted and there is no claim for alimony pending, or other situations such as cohabitation.
